1. Eligibility

You must be at least 13 years of age to use SproutMap. By creating an account, you represent that you meet this requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

2. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately at security@sproutmap.app if you suspect unauthorized access to your account.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Post or transmit harmful, threatening, abusive, defamatory, or otherwise objectionable content in community features
• Attempt to gain unauthorized access to any part of the Service, other users' accounts, or our systems
• Use automated tools (bots, scrapers, crawlers) to access the Service without our written permission
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
• Upload viruses, malware, or any other malicious code

4. Subscriptions & Payments

• SproutMap offers free and paid subscription tiers. Features available in each tier are described on our website and may change over time.
• Paid subscriptions are billed in advance on a recurring basis (monthly or annually) through Stripe.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — no partial refunds are provided.
• We reserve the right to change pricing with 30 days' notice. Price changes will not affect your current billing period.
• If payment fails, we may restrict access to paid features until the payment issue is resolved.

5. Your Content

• Ownership: You retain ownership of all content you create or upload to SproutMap, including garden plans, journal entries, photos, and community posts.
• License to us: By posting content to public areas of the Service (such as the Community), you grant SproutMap a non-exclusive, royalty-free, worldwide license to display, distribute, and reproduce that content within the Service.
• Private content: Content you create in private areas (garden plans, journal entries, seed inventory) is not shared with other users unless you explicitly choose to share it.
• Removal: You may delete your content at any time. When you delete your account, all associated data is permanently removed within 90 days, as described in our Privacy Policy.

6. Intellectual Property

The SproutMap name, logo, visual design, plant database content, and all associated intellectual property are owned by Craft and Counsel, LLC. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written permission.

7. Disclaimer of Warranties

SproutMap is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that planting dates, frost dates, or growing recommendations will be accurate for your specific location and conditions. SproutMap is a planning tool — actual growing results depend on weather, soil, technique, and many factors outside our control.

8. Limitation of Liability

To the maximum extent permitted by law, Craft and Counsel, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill, arising from your use of the Service.

In no event shall our total liability exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.

9. Indemnification

You agree to indemnify and hold harmless Craft and Counsel, LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another person or entity.

10. Termination

• You may close your account at any time from the Settings page or by contacting us.
• We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or for any other reason at our sole discretion with reasonable notice.
• Upon termination, your right to use the Service ceases immediately. Data deletion follows the timeline described in our Privacy Policy.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of North Carolina, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Buncombe County, North Carolina.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. For material changes, we will notify you by email or by a notice in the app. Your continued use of SproutMap after changes are posted constitutes your acceptance of the updated Terms.
